Texas is a community property state but there is no 50/50 rule. Courts apply a “just and right” analysis to the division of community assets. This analysis includes an evaluation of grounds for divorce, size of the estate, custody of children, and other mitigating factors that directly determine the outcome of the divorce.
An uncontested divorce saves the parties time and money. In these cases, the parties have minimal assets and/or have developed an agreement for the division of community assets and custody of children. As long as the parties remain in agreement, the divorce can be resolved as early as 60 days from the date of filing the petition.
